Opinion
Judgment modified, by inserting therein a direction for a nonsuit of plaintiff’s cause of action, except as to the item of $30.65, the amount paid for freight and cartage, for which judgment was directed in favor of the plaintiff against the defendant; and, as thus modified, the judgment is affirmed, .without costs of this appeal to either party.
