The decree appealed from which dismissed the cause with prejudice is modified to be without prejudice, and, so modified, is affirmed on authority of Smith v. Kleiser, 91 Fla. 84, 107 So. 262; Chestnut v. Robinson, 85 Fla. 87, 95 So. 428.

Modified and affirmed.
