JOY COSSICH LOBRANO, Judge.

| plaintiff, Ernest Rodney, appeals the February 13, 2012 judgment, granting the exception of prescription filed by Assurance Company of America. We hereby vacate the judgment appealed from, and remand this matter to the trial court for reconsideration in light of the recent Louisiana Supreme Court opinion in Duckworth v. Louisiana Farm Bureau Mutual Insurance Company, 2011-2835 (La.11/2/12), — So.3d -, 2012 WL 5374248.

JUDGMENT VACATED; REMANDED.
