Appellate Division of the Supreme Court of the State of New York·Decided February 15, 1935·Published
Opinion
Order reversed and motion denied upon the ground that, from the papers on appeal, there is no probability that the defendant will be successful in opposing the plaintiff’s allegations of misconduct on her part, and that there is no probability that defendant will succeed at the trial in establishing the facts upon which she seeks to obtain a decree of separation. Present — Martin, P. J., Merrell, O’Malley, Townley and Untermyer, JJ.
