Opinion

TO authorise the establishment of a public road, it is not sufficient vhat the viewers of the way report that the owners of the land consent. It must appear that they were summoned, or that they appeared in court. Lee vs. Hardwick, on authority of Lewis vs. Smith, L Marsh. 158, and Crawford vs. Snowden, 3 Litt. 228.
