Sedgwick, Ch. J., and Ingraham, J., held that the facts were the same as upon the former trial, and that the opinion of the former general term should be applied (see 48 Super. Ct. 274). O’Gorman, J., wrote dissenting opinion. Judgment affirmed, with costs.
