Action to recover damages for breach of contract. From an order denying defendant’s motion to dismiss the plaintiff’s third amended complaint or, in the alternative to strike out certain allegations in the pleading, defendant appeals. Order insofar as appealed from affirmed, with ten dollars costs and disbursements. No opinion. Close, P. J., Hagarty, Carswell, Adel and Aldrich, JJ., concur.
