          JUSTICE GABRIEL would grant as to the following issue:

         Whether the time-of-error obviousness analysis this Court espoused in People v. Crabtree, 2024 CO 40M, should be abandoned in favor of a time-of-appeal analysis, at least where the law was settled against the appellant at the time of trial.
