OPINION OF THE COURT

Per Curiam.

Order entered June 10, 1985 reversed, with $10 costs, tenant’s and undertenant Marie Vanderwaeren’s cross motions to dismiss the petition are denied, the petition is reinstated, and petitioner’s motion for leave to conduct disclosure is granted, for the reasons stated in Madison Co. v Derderian (130 Misc 2d 200 [App Term, 1st Dept]).
