Statement on Oral Argument Appellees do not believe oral argument is necessary in this case as the facts and legal arguments are adequately presented in the briefs and record, and the decisional process would not be significantly aided by oral argument. Specifically, Appellant failed to challenge every ground on which the Trial Court’s judgment may be affirmed, and Appellant failed to file a response to Appellees’ traditional and no-evidence motions for summary judgment. Thus, the appeal can be decided based solely on the briefs of the parties and the record on appeal.

Although Appellees do not believe oral argument is necessary, Appellees have requested oral argument in order to preserve their right to appear at oral argument in the event the Court decides to set the appeal for oral argument.
