Opinion

In an action for ejectment, the appeal is from an order denying appellants’ motion for summary judgment dismissing the complaint pursuant to rule 113 of the Rules of Civil Practice, and to cancel and discharge of record a lis pendens. Order affirmed, with $10 costs and disbursements. No opinion. Nolan, P. J., Wenzel, Ughetta, Hallinan and Kleinfeld, JJ., concur.
