DATTIMORE, J.

Conviction for theft of cattle; punishment, two years in the penitentiary.

We find in the record an affidavit in proper form, executed toy appellant and by him filed in this court, asking that his appeal be dismissed. The request is granted, and the appeal is dismissed.
