HARDY, Judge.

This is a companion suit to the action of John Byrd against the same defendant, No. 8919 on the docket of this Court, which has been this day decided. The cases were consolidated for purposes of trial and appeal.

For the reasons assigned in the opinion of this court in Byrd v. Elliott, 108 So.2d 248, the judgment appealed from is affirmed at appellant’s cost.
