PER CURIAM.

We affirm the Order Granting Defendant’s Motion to Dismiss with Prejudice, but modify it by substituting the words “without prejudice” for “with prejudice.” Edward L. Nezelek, Inc. v. Sunbeam Television Corp., 413 So.2d 51 (Fla. 3d DCA), [775]*775review denied, 424 So.2d 763 (Fla.1982); Fla.R.Civ.P. 1.090(d), 1.420(b).

Affirmed as modified.
