Opinion

DAUKSCH, Judge.

This is an appeal from a judgment dividing property. Although titled a final judgment, the order is not final because all judicial labor is not at an end. While the order declares the rights of the parties, it leaves open the disposition of property and specifically retains jurisdiction for a judicial sale if the parties do not abide by the agreement. Therefore, this appeal is sua sponte dismissed for lack of jurisdiction.

DISMISSED.

ORFINGER and COWART, JJ., concur.
