17 Plaintiff proceeds in this action in pro per. The matter was referred to a United 18 States Magistrate Judge pursuant to Local Rule 302(c)(21). 19 On February 4, 2025, the Magistrate Judge filed findings and 20 recommendations herein which were served on the parties and which contained 21 notice that any objections to the findings and recommendations were to be filed 22 within fourteen days. Plaintiff filed objections on February 14, 2025, and they were 23 considered by the undersigned. 24 The Court presumes that any findings of fact are correct. See Orand v. United 25 States, 602 F.2d 207, 208 (9th Cir. 1979). The Magistrate Judge’s conclusions of law 26 are reviewed de novo. See Robbins v. Carey, 481 F.3d 1143, 1147 (9th Cir. 2007) 27 (“[D]eterminations of law by the magistrate judge are reviewed de novo by both the 28 1 | district court and [the appellate] court... .”). Having reviewed the file, the Court finds 2 | the findings and recommendations to be supported by the record and by the proper 3 | analysis. 4 Accordingly, IT IS HEREBY ORDERED that: 5 1. The proposed Findings and Recommendations filed February 4, 2025, ECF 6 No. 39, are adopted in full; 7 2. Defendant's motion to dismiss, ECF No. 30, is GRANTED; 8 3. Defendant Folsom Lake College is DISMISSED; and 9 4.
