Oliver, P. J.

At the trial a sample of the mouth organs and a sample of the harmonicas were admitted in evidence and marked exhibits 1 and 2, respectively. The examiner, after examining the samples in evidence, testified that they were not toys and are similar in all material respects to those the subject of Abstract 47083. In accordance therewith the claim at 40 percent under paragraph 1541 (a) was sustained.
