J., Glennon, Callahan, Van Voorhis and Shientag, JJ.; Callahan, J., dissents and votes to reverse the judgment and dismiss the complaint on the ground that the proof was insufficient to warrant the relief awarded to the plaintiff in this action. The plaintiff, if so advised, may bring an appropriate action to establish his interest in the real property.
