Per Curiam :

The judgment appealed from is affirmed, without costs, and the order modified by striking from bill of costs eight dollars and five dollars disbursements for printing cases on first and second appeals, and as so modified affirmed, without costs. Present — Patterson, P. J,, Ingraham, Laughlin, Clarke and Houghton, JJ. Judgment affirmed, without costs, and order modified as stated in memorandum, and as modified affirmed, without costs.
