AFTER REMANDMENT

BOWEN, Presiding Judge.

The judgment of the circuit court is reversed and this cause is remanded for further proceedings in accordance with and as directed in the decision of the Alabama Supreme Court in Ex parte Powers, 546 So.2d 1004 (Ala.1988).

REVERSED AND REMANDED.
