Opinion

Arnoux, J.

Section 1013 of the Code gives a discretion to the court below to grant or to refuse the order [558]*558sought, and on this appeal we think that the order was within the proper exercise of that discretion (Martin v. Windsor Hotel Co., 70 N. Y. 101).

Truax, J., concurred. Order affirmed with costs.
