[1070]*1070 On Remand from the Alabama Supreme Court

LONG, Presiding Judge.

On the authority of Ex parte Phillips, 771 So.2d 1066 (Ala.2000), the judgment of the circuit court is reversed and this cause is remanded to the Circuit Court for Shelby County for proceedings consistent with the Supreme Court’s opinion.

REVERSED AND REMANDED.
