Opinion

In a proceeding pursuant to CPLR article 78 to compel appellant to issue a building permit, the appeal is from a judgment of the Supreme Court, Nassau County, entered February 25, 1975, which, inter alia, granted the application. Judgment affirmed, with $20 costs and disbursements. We are in accord with the reasons given by Special Term for granting the relief requested by petitioners. Rabin, Acting P. J., Cohalan, Margett, Brennan and Shapiro, JJ., concur.
