PER CURIAM.

Granted in part. The case is remanded to the court of appeal to consider and rule on the notice issue which is an element of the cause of action that the plaintiff must prove. This issue was raised in the Parish’s reply brief and should have been addressed by the court of appeal. Otherwise, denied.
