McMILLAN, Presiding Judge.

Pursuant to the Alabama Supreme Court’s decision in Ex parte Perry, 814 So.2d 840 (Ala.2001), the trial court’s judgment is due to be reversed and the cause [845]*845remanded to the trial court for proceedings consistent with that opinion.

REVERSED AND REMANDED.
