STOKER, Judge.

This is a companion case to Deville v. Budd Construction Co., 617 So.2d 570 (La. App. 3d Cir.1993), rendered on April 7, 1993, under Docket No. 92-221 of this court. For the reasons given in Deville, the judgment of the trial court is affirmed. Costs of this appeal are assessed to the State, DOTD.

AFFIRMED.
