Opinion
Motion to dismiss the appeal herein denied. The request in appellant’s answering papers for a CPLR 5520 (subd [a]) extension of time within which to cure the failure to file a notice of appeal is deemed a cross motion for such relief and is granted. The notice of appeal shall be filed within seven days from service of a copy of this order on appellant.
