Opinion

Application by the appellant for a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, a decision and order of this Court dated May 1, 2007 (People v White, 40 AD3d 662 [2007]), affirming a judgment of the Supreme Court, Kangs County, rendered September 15, 2003.

Ordered that the application is denied.

*877 The appellant has failed to establish that he was denied the effective assistance of appellate counsel (see Jones v Barnes, 463 US 745 [1983]; People v Stultz, 2 NY3d 277 [2004]).
