Per Curiam:

The judgment allowing the demurrer should be reversed and the demurrer disallowed, on the authority of People v. Finkelstein (167 App. Div. 591) and the case remitted to the Court of Special Sessions for further proceedings. Present — Ingraham, P. J., McLaughlin, Laughlin, Clarke and Scott, JJ. Judgment reversed, demurrer disallowed, and the case remitted to the Court of Special Sessions for further proceedings. Order to be settled on notice.
