Opinion

Judgment of conviction and orders affirmed. Memorandum: We disregard under the provisions of section 542 of the Code of Criminal Procedure the statement in the summation of the district attorney to which exception was taken. All concur. (The judgment convicts defendant of violation of subdivision 2 of section 2460 of the Penal Law. The orders deny motion for a new trial and arrest of judgment.) Present — Sears, P. J., Crosby, Lewis, Cunningham and Taylor, JJ.
