Opinion

Appeal by defendant from a sentence of the Supreme Court, Kings County, imposed April 29, 1976, upon his conviction of attempted assault in the second degree, upon his plea of guilty, the sentence being a five-year period of probation. Sentence affirmed, without prejudice to the making of an application, if defendant be so advised, to the Criminal Term pursuant to CPL 410.90. No opinion. Martuscello, J. P., Latham, Damiani and Cohalan, JJ., concur.
