Opinion

Appeal by defendant from a judgment of the Supreme Court, Kings County, rendered January 27, 1964 on his plea of guilty, convicting him of attempted robbery in the third degree, unarmed, and iinposing sentence as a third felony offender. On June 24, 1963 this court reversed defendant’s conviction of attempted robbery in the first degree and ordered a new trial (People v. Rivera, 19 A D 2d 657). Judgment affirmed. No opinion.
