Opinion

—Order, Supreme Court, Bronx County (Fred Eggert, J.), entered April 27, 1993, granting defendant’s motion to dismiss the indictment, unanimously reversed, on the law, and the indictment reinstated.

We reverse and reinstate the indictment for the reasons set forth in our memorandum decision in People v Clarke (210 AD2d 80 [decided herewith]). Concur—Sullivan, J. P., Ellerin, Kupferman and Asch, JJ.
