Opinion

Appeal by defendant from an order denying his motion to transfer the trial of a criminal action from the County Court of Queens County to the Supreme Court of Queens Countyi Appeal dismissed. (See People V. Perito, post, p. 823, decided herewith.) It is our opinion, however, that the motion should have been granted. Hagarty, Acting P. J., Carswell, Johnston, Nolan and Sneed, JJ., concur.
