P., as in People v Candella (171 AD2d 329). (Appeal from Judgment of Niagara County Court, Hannigan, J.—Criminal Sale Controlled Substance, 5th Degree.) Present—Boomer, J. P., Pine, Boehm, Fallon and Davis, JJ.
