Appeal from a judgment of [495]*495the County Court of Schenectady County (Best, J.), rendered May 11,1983, upon a verdict convicting defendant of the crimes of rape in the first degree, sodomy in the first degree and official misconduct (two counts).

From the early morning hours of Saturday, September 12, 1981, until the morning of Monday, September 14, 1981, Dale Voorhees was incarcerated at the Schenectady County Jail pending arraignment on a charge of disorderly conduct.
