Return of remittitur requested and when returned, it will be amended to read as follows: “ Judgment modified by remitting the ease to Supreme [845]*845Court, Bronx County, for further proceedings in accordance with the mandate of the Supreme Court of the United States.” [See 22 N Y 2d 55, vacated and remanded 396 U. S. 102.]
