Opinion

Brown, J.

The defendant has been convicted on his plea of guilty in a Court of Special Sessions of the town of Pitcher, Chenango county, of the crime of petit larceny. He appeals to this court, challenging the judgment of conviction, principally upon the ground that the information upon which the warrant was issued was insufficient. It is his contention that there is no allegation in the information that charges the offense to have been committed with criminal intent.

The information upon which the warrant was issued is as follows:

Be It Remembered, That I, Ross Brown, residing in the Town of Pharsalia, County of Chenango, N. Y., now come before L. D. Greenleaf, Esq., a Justice of the Peace of Pharsalia in the County of Chenango, N. Y., and give information under oath as follows:

“ That one Frank Knapp and George Brazee, on the 30 day of May, 1934, at the Ross Brown, in the Town of Pitcher, County of Chenango, N. Y., at about Three O’clock in the afternoon of said day, did commit the crime of Petit Larceny against the [person or]
