Motion for leave to appeal as a poor person denied, and upon the court’s motion the appeal taken by defendant-appellant from the judgment of the Court of General Sessions, New York County, rendered on October 7, 1960 is dismissed on the ground that the notice of appeal was not timely filed as required by section 521 of the Code of Criminal Procedure. Concur — Breitel, J. P., Valente, Stevens, Steuer and Bergan, JJ.
