OPINION OF THE COURT

Order modified by reversing the conviction of defendant James H. Northrop, Inc., remitting the fine and dismissing the accusatory instrument against said defendant and, as so modified, affirmed (see Sokolov v Village of Freeport, 52 NY2d 341).
