(Cf. People v. Richardson, 4 N Y 2d 224, cert. den. 357 U. S. 943; People v. Pugach, 14 N Y 2d 943.) Gibson, P. J., Herlihy, Reynolds, Aulisi and Staley, Jr., JJ., concur.
