Opinion

Appeal by defendant, as limited by his brief, from a sentence of the Supreme Court, Kings County, imposed December 27, 1972. Appeal dismissed. The appeal was untimely taken. Defendant was sentenced on December 27, 1972. The notice of appeal was dated February 7, 1973 and filed February 9, 1973. It incorrectly states the date of sentence as January 8, 1973. If the appeal were correctly before us, we would affirm the sentence. Gulotta, P. J., Hopkins, Martuscello, Latham and Christ, JJ., concur.
