Motion granted insofar as to extend the defendant’s time to serve and file the record on appeal and the appellant’s points to and including September 8, 1959, with notice of argument for the October 1959 Term of this court, said appeal to be argued or submitted when reached. Respondent’s points are to be served and filed on or before September 23, 1959. Concur — Breitel, J. P., Rabin, Yalente, Stevens and Bergan, JJ.
