Opinion

On a trial before a city magistrate, sitting as a Court of Special Sessions, the defendant was convicted of the crime of driving a motor vehicle while intoxicated, in violation of subdivision 5 of section 70 of the Vehicle and Traffic Law. Judgment of conviction unanimously affirmed. No opinion. Present — Lazansky, P. J., Hagarty, Carswell, Davis and Close, JJ.
