Judgment unanimously affirmed. Memorandum: Viewing the evidence in the light most favorable to the People (see, People v Contes, 60 NY2d 620), we conclude that the People’s proof was sufficient to negate defendant’s agency defense. (Appeal from Judgment of Niagara County Court, DiFlorio, J. — Criminal Sale Controlled Substance, 3rd Degree.) Present — Callahan, J. P., Boomer, Pine, Lawton and Fallon, JJ.
