Concur: Chief Judge Desmond and Judges Dye, Van Voorhis, Burke, Scileppi and Bergan. Judge Fuld dissents and votes to reverse the order appealed from and to reinstate, the order of the trial court suppressing the evidence on the ground that such evidence was the product of an unlawful search and seizure.
