Concur: Chief Judge Desmond and Judges Van Voouhis, Soileppi, Bergan and Keating. Judges Fuld and Burke dissent and vote to reverse and to dismiss the indictment upon the ground that the proof does not establish defendant’s guilt beyond a reasonable doubt.
