Opinion
Motion for consolidation granted insofar as to direct that the two appeals be heard together. The appeal taken by defendant Francisco Cruz is adjourned to the April 1962 Term of this court, to be heard together with the appeal taken by defendant Rogelio Soto. Respondent is permitted to file one set of points covering the appeals in both actions. Concur—McNally, J. P., Stevens, Eager, Steuer and Bastow, JJ.
