Motion to vacate dismissal of appeal granted [see, 92 NY2d 947], and appeal reinstated and continued on the same terms as the certificate dated July 6, 1998. The time for argument or submission of the appeal is hereby extended and the stay is continued until determination of the appeal. The appeal is set down for argument on January 6, 1999, the People’s brief to be served and filed on or before December 21, 1998.
