Opinion

Judgment, convicting defendant of a violation of section 1140 of the Penal Law, reversed, on the law and on the facts, and the information dismissed. The People have failed to establish the guilt of the defendant beyond a reasonable doubt. Concur—Botein, P. J., Rabin and Stevens, JJ.; McNally and Eager, JJ., dissent and vote to affirm.
